Terms.
The agreement between you and Construct when we work together.
1. The relationship
Construct ("we," "us") provides infrastructure services — custom builds, hosting, maintenance, email, and AI customer inquiry handling. You ("client," "you") pay a monthly fee for these services. This page describes the default terms. A signed statement of work overrides anything here that conflicts with it.
2. Infrastructure, not a server
We sell infrastructure, not a server. You are entitled to everything that keeps your business online: your website, email, hosting, backups, security, monitoring, AI customer inquiry handling, status page, monthly report, and small content updates. These are part of your plan, not add-ons.
Additional services (content updates packs, priority response, custom feature development, rescue projects) are optional and quoted separately.
3. Pricing
Prices are quoted as a monthly recurring fee, with a yearly option that gives a discount in exchange for an annual commitment. The 3-month minimum covers the cost of the initial build, with the flat monthly rate applying thereafter. We don't raise prices mid-term. At renewal, we give you 30 days' notice of any change, and you can leave without penalty if you don't want to accept it.
There is no separate build fee. The monthly fee covers both the initial build and ongoing infrastructure, maintenance, and support.
4. Build phase
We typically start within 14 days of your first payment. We deliver a preview at a temporary URL. You have 7 days to review and request changes. One 7-day extension is included. We do not stop until you are satisfied with the result.
5. Go-live and billing
When you approve the build, we deploy to your domain and monthly billing begins. The first month is billed on go-live. Subsequent months are billed on the same date each month. Payments are processed by your payment processor. You authorize recurring charges.

- Daily encrypted backups (downloadable at any time)
- Uptime monitoring
- Security patches and updates
- Status page access

- 1-business-day support response (email only)
- Small content updates (text edits, photo swaps, bug fixes)
7. Email
Your business gets the email it needs, at no extra charge. Email is part of your plan, not a paid add-on.
8. Scaling (no overage fees)
Each tier has a natural fit (typical visitor count and account count). These are guidance, not hard caps. We do not charge overage fees or automatically upgrade you. When your usage grows significantly past the natural fit (roughly 2x), we will reach out and discuss options: upgrade tiers, optimize, or add capacity without changing your tier. The decision is yours.
9. Minimum commitment
The infrastructure subscription has a 3-month minimum. After the 3rd paid month, you may cancel with 30 days notice. We do not pro-rate refunds on the minimum.
10. Code ownership
After the 3rd paid month, the full source code for your project is transferred to an account you control. Documentation, runbooks, credentials, AI prompts, and infrastructure configuration are handed over. From that point, the code is yours. You may self-host, take it elsewhere, or hire another team.
11. The permanence promise
If Construct ever ceases operations, you keep everything. We will provide at least 90 days notice, a final handover package (code, credentials, docs, database export, AI configuration), and free migration support for 30 days. Your business does not depend on our business surviving. This is a binding commitment.
12. What we maintain
While you are an active subscriber, we patch security vulnerabilities, renew SSL certificates, run backups, monitor uptime, and respond to incidents. We maintain your AI customer inquiry handling. We do not commit to specific response times unless stated in your statement of work.
13. What we don't do
We don't promise 100% uptime. We don't accept liability for client-side changes, third-party service outages outside our stack, or business losses from downtime. We don't work on projects that violate the law. We don't provide graphic design services (logos, branding, illustration).
14. Payment
Payments are processed by your payment processor. You authorize recurring charges for the subscription. Failed payments are retried over 7 days. After that, services may be suspended. We will notify you before any suspension.
15. Confidentiality
Both parties keep the other's business information confidential. This survives the end of the engagement.
16. Disputes
We try to resolve disputes directly. If we can't, this agreement is governed by the laws of Jamaica. Disputes are subject to the exclusive jurisdiction of the courts of Jamaica, with venue in Kingston.
17. Changes to these terms
If we change these terms, current subscribers get 30 days notice before they take effect. New terms apply to new engagements immediately.
