What we agree to do, in plain language.
This is the short, readable version. The legal version is on /terms. The two say the same thing in different words. If they ever disagree, the legal version wins.
Construct is a one-person partner for local service businesses. We design, build, and run the online side of your business — the website, the booking, the email, the AI, the analytics. You focus on the work. We focus on the tech.
This page says what we commit to, in plain language. No "stakeholders", no "synergies", no legalese. If we ever disagree about what was promised, this is the document we point to first.
Why it exists.
The 3-month minimum covers the cost of building your site. After that, you can leave anytime — we hand over everything. Most people stay. The model works because we both want the same thing: your business online and successful.
The 3-month minimum is a contract for effort on both sides. You commit 3 months of fee. We commit 3 months of work, hosting, and maintenance. After that, the contract is month-to-month. No exit fees, no penalties.
Yearly billing, if you'd rather pay upfront
Both plans are also available as a yearly option, paid upfront. The 3-month minimum still applies. If you leave before the 12-month term ends, you do not receive a refund of the remaining months — the lower annual rate covers the upfront commitment. After the 12-month term ends, billing reverts to month-to-month unless you choose to renew.
When you can get money back, and when you can't.
The 7-day preview window is the real try-before-you-buy. If you reject the work during preview, you don't go live and you don't pay. After go-live, the 3-month minimum applies.
| When you cancel | Refund | Why |
|---|---|---|
| After signing up, before work starts (before day 1) | Full refund | No work done. No money owed. |
| During the 7-day preview (days 7-14) | Full refund | The preview window is the try-before-you-buy. The work isn't billed until you approve go-live. |
| After go-live, within the 3-month minimum (months 1-3) | No refund | You have a working, live site. The 3-month minimum covers the build. You can leave at the end of month 3 with everything. |
| After the 3-month minimum (month 4+) | Cancel anytime | Month-to-month. No refund needed. We cancel at the end of the current month and hand over everything. |
How to ask for a refund
Email hi@buildconstruct.dev. State your name, your domain, and that you'd like a refund. We confirm within 1 business day. Money is back in your account within 5 business days of the confirmation.
What we don't refund
- Work that has gone live and is being used.
- Optional services you've already received (content updates pack, rescue service, custom development).
- Third-party fees we paid on your behalf (domain registration, app store fees, paid API subscriptions you asked for).
- Months billed under a month-to-month arrangement after the 3-month minimum.
- The unused portion of a yearly plan if you cancel before the 12-month term ends.
Service failures
If our infrastructure fails in a way that costs you money (site down for hours, payments broken, AI replies not sending), that's a service credit, not a refund. We document the incident, credit your next invoice for the affected time, and tell you what we changed to prevent it happening again.
How fast we reply.
Email replies within 1 business day, Jamaica time (UTC-5, Monday to Friday). Always. If we don't reply in a business day, email again — sometimes things fall through the cracks and the second nudge gets it moving.
Emergencies (site down, can't take bookings, payments broken) within 4 hours, 7 days a week, Jamaica time. We define an emergency as something that's costing you money right now. If you're not sure, email and mark it "urgent" — we will tell you if it isn't.
We are a one-person operation. There is no after-hours support team. If you email at 3am on a Sunday, the response might be at 7am Monday unless you've marked it an emergency. That's the trade for the price.
The code is yours at month 3.
At the end of month 3, you own everything we built. Full ownership. Source code, design files, customer database export, all account credentials, AI prompts and configuration, deployment documentation, and a walkthrough of how to run it yourself.
If you stay
We keep running it. Hosting, security, backups, AI, edits — all on the same flat fee. We don't raise prices mid-term. At renewal, we give you 30 days' notice of any change, and you can leave without penalty if you don't want to accept it.
If you leave
You take everything with you. We provide a handover package and walk you through the deployment yourself if you want it. You can host it on your own infrastructure, hand it to another developer, or sell it with the business. No penalties, no exit fees, no questions.
What's not in the handover
- Our internal tooling (the parts of our build pipeline that aren't specific to your site).
- Components we license from third parties (rare; we tell you up front if anything in your site is third-party licensed).
- The Construct brand. You own your site, not our name.
Where the line is.
We are a one-person operation. The package covers what we commit to in your plan. Things outside the package are available, separately priced, with a quote before work starts. This section is the line.
What's included in your monthly fee
- Hosting, security certificate, daily backups, uptime monitoring, security patches — applied the day they ship.
- Custom domain, custom domain email, DNS, email routing.
- The AI features in your tier: FAQ chatbot, email triage, weekly summary (Standard) or the equivalents in your tier.
- Up to 2 hours per month of small changes: text edits, photo swaps, new pages, layout adjustments. Same day for small things, same week for the rest.
- 1-business-day response on non-urgent requests, 4-hour response on emergencies (site down, can't take bookings, payments broken) — 7 days a week. All times Jamaica time (UTC-5).
- Monthly usage report — where your bookings came from, what customers asked, what to fix.
What's not included
- Third-party fees we pass through at cost: domain registration, paid third-party API usage above your tier's allowance, payment processing fees (charged by your payment processor, not us), app store fees, paid SMS or email service fees above your tier's allowance.
- Graphic design work we don't do: logos, branding, illustration, photography, video. We design the website; we don't build your brand.
- Custom feature development beyond your tier. Quoted separately, scope agreed before work starts.
- Content writing beyond the small-change allowance: blog posts, marketing copy, photography direction. Available as a paid add-on (see /pricing).
- Training, consulting, on-boarding your staff on how to use tools outside what we maintain.
- Social media management (posting on your behalf across platforms), ad campaign management, and unified messaging inboxes (Messenger + Instagram DM + WhatsApp in one UI). These are not part of any tier. We can build integrations with these services as separate projects — each scoped and quoted before work starts.
Fair use
Your tier has a natural fit for visitor count and customer accounts. Roughly 2x that natural fit is a fair-use line. Beyond that, we talk — we don't auto-bill, we don't cut you off, we have a conversation. Either we upgrade, we optimize, or we add capacity without changing your tier. Same applies to AI usage: heavy use is fine, abusive use (mining, large-scale scraping, anything not your business) is not.
This is not a hard cap. We don't meter your traffic. The line is "this still looks like one local business running one website." When it stops looking like that, we talk.
Support scope
Support is for things we built. "Can you add a new page to my site?" Yes, included. "Can you help me set up my QuickBooks?" No, that's not what we do. "Can you explain why my payment processor payout is short?" Yes, included. "Can you debug my printer?" No.
If we get a support request that falls outside what we built, we tell you, and we suggest who can help. We don't bill you for the "this is outside our scope" reply.
Your business does not depend on ours surviving.
If Construct ever ceases operation — for any reason — the following happens, automatically and in writing:
- You receive a 90-day notice by email.
- You receive a complete handover package: source code, design files, database export, all credentials, deployment documentation.
- We provide free migration help for 30 days from the date of the notice. Email questions answered within 1 business day.
- At the end of the 90 days, you are running your site on infrastructure you control, or you have hired someone else to run it.
This is the only scenario in which the handover happens without you asking. The same package, the same 30 days of free migration help, the same commitment. You don't lose your business because we lose ours.
How to raise a problem.
Email hi@buildconstruct.dev with a short description of the problem. State what happened, when, and what you'd like us to do about it. We respond within 1 business day with either a resolution or a timeline for the resolution.
Most problems are fixed in one or two emails. For the rare ones that aren't, the legal terms on /terms describe the formal process. We've never had to use it. We don't expect to.
We build it. We run it. You keep it.
That is the whole deal. Written down, in plain language, on this page.
